Additional Prize Conditions
5. The Prize and all elements of the Prize must be taken as and when offered or will be forfeited, and if forfeited, the Promoter will not be liable.
6. The Prize is subject to any additional terms and conditions imposed by the Promoter, as reasonably required, including conditions related to the claiming of the Prize
7. Accommodation is subject to availability at the time of Prize redemption.
Travel is valid during the following periods:
• 1 November 2026 to 31 March 2027, excluding the blackout period from 20 December 2026 to 10 January 2027; and
• 1 November 2027 to 19 December 2027.
Travel is not valid from 1 April 2027 to 31 October 2027.
The prize must be fully redeemed, and all travel completed, by 19 December 2027. If the winner is unable to complete their travel by this date, the prize will be forfeited.
8. If the Winner is unable to redeem the Prize by 19 December 2027, the Prize will be forfeited.
9. The Prize includes return Jetstar international flights from Sydney or Brisbane to Rarotonga for up to four (4) people, return domestic flights from the Winner’s closest Australian airport to Sydney or Brisbane for up to four (4) people (if required), five (5) nights’ accommodation for up to four (4) people in a Premium Family Room at Pacific Resort Rarotonga, return Rarotonga airport transfers for up to four (4) people, daily tropical breakfasts at Sandals Restaurant, complimentary unlimited Wi-Fi, complimentary local and international calls, and complimentary use of kayaks, sun loungers and beach towels at Pacific Resort Rarotonga.
10. The Winner is responsible for all other expenses relating to the Prize that are not expressly included in these Terms and Conditions, including travel insurance and any other personal or incidental expenses.
11. Pacific Resort Hotel Group’s cancellation policy applies to all bookings.
12. Once booked, no changes can be made to the booking.
13. The Prize is not transferable or exchangeable and cannot be redeemed for cash.
14. The Prize cannot be combined with any live specials or tactical campaigns available in the marketplace and cannot be booked through a travel professional or travel wholesaler.
15. The Winner must be aged eighteen (18) years or older and must comply with all applicable Cook Islands entry requirements. The Winner and each travelling companion are responsible for ensuring that they hold all passports, visas and other documentation required for travel to and entry into the Cook Islands and otherwise comply with all applicable entry requirements.
16. Cook Islands Tourism and Pacific Resort Hotel Group strongly recommend that the Winner and their travelling companions purchase appropriate travel insurance.
17. All travel is subject to the terms, conditions and carriage requirements of the relevant airline and other travel providers. The Promoter is not responsible for any cancellation, delay, rescheduling or other change to flights or other travel arrangements caused by an airline or other third-party travel provider, except to the extent required by law.
18. If the Prize or any element of the Prize becomes unavailable for any reason beyond the Promoter’s control then a similar prize of equal or greater value will be awarded to the Winner in lieu, subject to the approval of the relevant regulatory authorities (if required). Without limiting the foregoing, the Promoter may, at their absolute discretion, substitute cash for the Prize or any component of the Prize (the amount of cash being equal to the Prize, or component of the Prize, value specified in these Terms and Conditions).
19. All Prize advertisements depicting or describing the prizes and trademark references are illustrative rather than depictive and do not imply an association with the Promoter.
Unclaimed Prize
20. All reasonable efforts will be taken to contact the Winner, however the Promoter takes no responsibility for unread, undelivered or incorrectly provided email information.
21. If the Prize has not been accepted or claimed, or if, after making all reasonable attempts, the Winner cannot be contacted and the Prize remains unclaimed within one (1) month from the Prize Draw Date, the Winner will be deemed to have forfeited the Prize and will have no further claim. The Promoter will either award the Prize to a Reserve Winner or conduct an unclaimed prize draw at the same time and location as the original draw, one (1) week after the Prize is deemed forfeited (“Unclaimed Prize Draw”).
22. Any Any new Winner from the unclaimed prize process will be notified by email within one (1) business day of the Unclaimed Prize Draw. The new Winner’s full name and postcode will be published on the Promoter’s website within three (3) business days after the new Winner has provided the Promoter with their full name and postcode for publication and will remain available for a period of thirty (30) days.
23. This process will continue, with the same timeframes, until a Winner is successfully contacted and accepts the Prize.
Releases
24. To the extent permitted by law, by entering this Competition, you agree to release, discharge, indemnify, and hold harmless the Promoter and any Partner (if any), and their respective directors, officers, employees, agents, contractors, and affiliates, (collectively, the "Released Parties") from any claims, actions, losses, damages, liabilities, costs, or expenses of any kind (including, without limitation, legal costs and expenses on a full indemnity basis) arising out of, or in any way connected with, your participation in this Competition or any Competition-related activities (including, without limitation, attendance at events, travel, or other activities) and the acceptance, use, misuse, or possession of any prize awarded hereunder. This includes, without limitation, any claims arising from: (i) non-compliance by you with these Terms and Conditions; (ii) any malfunction, technical failure, error, delay, or other problem arising in connection with the collection, processing, storage, or retention of entry information; (iii) any typographical or other error in the administration of the Competition or announcement of any winner; (iv) any act or omission of the Released Parties, whether negligent or otherwise, and (v) any personal injury, property loss or damage, or death arising in connection with your participation in the Competition or acceptance or use of any Prize.
25. Nothing in these Terms and Conditions excludes, restricts, or modifies any rights that you may have under the Australian Consumer Law (ACL) or other applicable consumer protection legislation that cannot be excluded, restricted, or modified by agreement. However, to the fullest extent permissible by law, the Promoter and the Released Parties will not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits, revenue, goodwill, or opportunity, arising out of or in connection with your participation in the Competition or use or misuse of any Prize, even if the Promoter was advised of the possibility of such damages.
26. As a condition of accepting the Prize, the Winner may be required to sign a legal document, in a form determined by the Promoter at their sole discretion, which may include a release and indemnity. Failure to sign any such document will result in the Winner's entry being deemed invalid, and they will forfeit any entitlement to the Prize
Conditions
27. Entrants consent to the use of their names, likeness or image by the Promoter if they are the winner of the Prize for an unlimited period of time without remuneration. Entrants agree to comply with any reasonable direction of the Promoter in this regard.
28. If, for any reason, this competition cannot run as planned due to events such as war, terrorism, state of emergency, natural disaster, pandemic, computer virus, telephone network failure, unauthorized tampering, fraud, technical failures, or any other cause beyond the Promoter's control, the Promoter reserves the right, at its sole discretion, to cancel, terminate, modify, or suspend the competition, or invalidate any affected entries. This is subject to the approval of relevant authorities, if required. The Promoter will not be liable for any failure or delay in performing its obligations under these Terms and Conditions due to any act, omission, event, or circumstance beyond its reasonable control.
29. The Promoter reserves the right, at any time, to verify the validity of Entrants (including an Entrant’s identity, age and place of residence) and reserves the right, in its sole discretion, to disqualify any individual who the Promoter have reason to believe has breached any of these Terms and Conditions, tampered with the entry process or engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the Competition.
30. Any entries or nominations that are deemed by the Promoter, in its sole discretion, to be rude, defamatory, offensive, illegal, incomprehensible, incorrect, incomplete, or that breach any law or infringe on third-party rights, including intellectual property rights, will be invalid and may be removed by the Promoter.
31. The Promoter does not knowingly collect personally identifiable information from persons under the age of eighteen (18) years old. Such persons are expressly prohibited from submitting their personally identifiable information to Promoter and any information submitted by such users will not knowingly be used, posted, or retained by Promoter.
32. The Promoter reserves the right to cancel or amend the Competition and these Terms and Conditions if necessary, for reasons outside of its control or as required by law. Any such changes will be communicated to entrants as soon as reasonably possible. Failure by the Promoter to enforce any of their rights at any stage does not constitute a waiver of those rights.
33. By entering this Competition, Entrants explicitly consent to the storage and use of their personal information by the Promoter, its related bodies corporate, and, where applicable, the Partner, for future promotional and marketing purposes. This includes contacting Entrants via the contact details provided (e.g., email, phone, SMS, or other forms of communication). Entrants also consent to being added to the marketing and promotional mailing lists of both the Promoter and, if applicable, the Partner.
34. If you are a Winner, the Promoter will use your personal information to conduct and manage the Competition. The Promoter may disclose your personal information to its related bodies corporate or the Partner to assist in administering the Competition, communicating with you, or storing data. Your personal information will be handled in accordance with the Promoter’s and, if applicable, the Partner’s, Privacy Policy(ies).
35. Without limiting the foregoing, Entrants’ personal information provided in connection with this Competition will be handled in accordance with the Privacy Policy (or Privacy Policies, if a Partner is involved in the Competition) and the Privacy Act 1988.
36. These Terms and Conditions are governed by the laws of the Australian State or Territory in which the entrant resides, and the parties submit to the jurisdiction of the courts of that State or Territory.
37. This Competition is in no way sponsored, endorsed or administered by, or associated with any social media platform, including, but not limited to, Facebook, TikTok, Instagram and Twitter. Entrants provide their information to the Promoter and not to any social media platform. Entrants completely release any relevant social media platforms from any and all liability.
